The contracting procedure for the service is carried out entirely electronically through the website www.arcos.com, having the same validity as a contract signed in person.

These general conditions of sale, detailed below, are the only ones applicable and replace any other condition or prior agreement, unless the parties expressly agree in writing to a different arrangement that annuls or modifies these general contracting conditions.

The language used throughout the contracting process shall be Spanish, and it shall govern the relationship between the parties. The display of information in any other language shall be considered subordinate to the Spanish version; in the event of any discrepancy, the Spanish version shall prevail over any other translation or adaptation.

ARCOS HERMANOS, S.A. may occasionally modify the provisions contained in these General Conditions; therefore, it is advisable to read them each time you visit store.arcos.com. These modifications shall take effect from the date of publication, shall not have retroactive effect, and shall not apply to purchases made prior to their publication — previous versions will always be available through the links provided on the platform and may be printed and/or downloaded using the button established for that purpose.

Each purchase made on the website is governed by the General Conditions applicable on the date of the order. Once you have placed an order, it is understood that you have read and unreservedly accepted our General Conditions of Sale.

Payment will be charged at the time of order confirmation, provided that authorization from the customer’s bank has been obtained. The website guarantees that the payment process is completely secure, as it uses the appropriate security measures at all times (SSL protocol certified by GlobalSign and SHA256 encryption) to ensure and protect the privacy of the data provided by the customer.

Safeguard Clause

All clauses or sections of this contract must be interpreted independently and autonomously, and the remaining provisions shall not be affected in the event that any of them is declared null and void by a final court ruling. The contracting parties agree to replace the affected clause(s) with another or others that preserve the intended effects.

Dispute Resolution

ARCOS HERMANOS, S.A. shall not be held responsible for the non-performance of these conditions in cases of force majeure, as defined by Spanish courts, or in cases of fault by the customer or an unforeseeable act by a third party unrelated to the contract.

For any dispute arising from the non-compliance with the conditions of sale, both parties expressly submit to the Courts and Tribunals of Albacete (Spain), except as otherwise provided by consumer protection regulations, waiving any other jurisdiction that may correspond to them.

ARCOS HERMANOS, S.A. shall not be held liable for any consequences that may result from the improper use of the products sold on its website.
